Release Waiver

I acknowledge that all classes, practice sessions, and events conducted by the academy, reasonable care is taken to prevent serious

injuries and to minimize accidents. It is required that students obey the rules and regulations of the academy. Recognizing that the

strenuous nature of this activity involves risk of injury. I agree to hold the academy, its officers, instructors, guests and members free

and harmless from any liability or damages.

In consideration of being permitted to participate in any way in the Martial Arts Program indicated below and/or being permitted to

enter for any purpose any restricted area (here defined as any area where admittance to the general public is prohibited), the member

and/or the parent(s) and/or legal guardian(s) of a minor participant named below agree:

1. The participant and/or the parent(s) and/or legal guardian(s) of a minor participant will prior to participating in the below martial

arts activity or any such related events, inspect the facilities and equipment to be used, and if he or she believes anything is unsafe,

will immediately advise the officials of such condition and refuse to participate. I understand and agree that, if at any time, I feel

anything to be UNSAFE, I will immediately take all precautions to avoid the unsafe area and refuse to participate further.

2. I / WE fully understand and acknowledge that:

a. There are risks and dangers associated with participation in martial arts events and activities which could result in bodily

injury, partial and/or total disability, paralysis, and death.

b. The social and economic losses and/or damages, which could result from these risks and dangers described above, could be

severe.

c. These risks and dangers may be caused by the action, inaction or negligence of the participant or the action, inaction or

negligence of others, including, but not limited to, the Releasee(s) named below.

d. There may be other risks not known to us or are not reasonably foreseeable at this time.

3. I/WE accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or

death, however caused and whether caused in whole or in part by the negligence of the Releasee(s) named below.

4. I/WE HEREBY RELASE, WAIVE, DISCHARGE, AND CONVENANT NOT TO SUE the martial arts facility used by the participant, including

its owners, managers, promoters, lessees of premises used to conduct the martial arts event or program, premises and event

inspectors, underwriters, consultants and others who give recommendations, direction, or instructions to engage in risk evaluation

or loss activities regarding the martial arts facility and events held at suck facility and each of them, their directors, officers, agents,

employees, all for the purposes herein referred to as “Releasee”… FROM ALL LIABILITY TO THE UNDERSIGNED, my / our personal

representative, assigns, executors, heirs and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES AND ANY

CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT

OR DAMAGE TO PROPERTY ARISING OUT OF OR RELATING TO THE EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR

PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.

5. I/WE HEREBY acknowledge that THE ACTIVITES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or

death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges that INJURY RECEIVED MAY BE

COMPOUNDED OR INCREASED BY THE NEGLIGENT RESCUE OPERATION OR PROCEDURES OF THE RELEASEES.

6. EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be

as board and inclusive as is permitted by the law of the Province, State, or Commonwealth in which the event is conducted and that

if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

7. On behalf of the participant and individual, the undersigned parent(s) and/or legal guardian(s) of a minor participant executes the

Waiver and Release. If, despite this release, the participant makes a claim against any of the Releasee(s), the parent(s) and/or legal

guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them

harmless.

8. I/WE understand I/WE are participating in full-contact combat sports and that people can/do get injured participating in these

activities.

9. I/WE understand that I/WE will be in close proximity to other members, coaches and parents, spectators and that I/WE may be

exposed to any number of germs, viruses, etc.

10. I agree to all policies and procedures of the academy including the hygiene policy outlined below:

HYGIENE POLICY

• You must wash your uniform / clothing prior to each training session.

• You must always practice good hygiene in the academy.

• Shoes (Footwear) are always required off the mats.

• Shoes (Footwear) are always prohibited on the mats.

• If you are sick/unwell, stay home or you will be sent home.

• No spectators are allowed except for parents or perspective students.

• No food is allowed in the academy by students, perspective students or parents.

• No drinks are allowed in the academy except for students.

• Face masks and/or face coverings are strongly recommended for parents and perspective students.

• No clothing or uniforms are to be left at the academy.

• No personal items are to be left at the academy.

• Always wear headphones when using a mobile device in public.

• All students must sign an updated waiver / release when asked.

• You must wipe down equipment in the workout area before and after each use.

• Practice social distancing as much as possible while not on the mats with other students.

RELEASE

1. I understand and accept that this this facility is under 24/7 video and audio surveillance.

2. I hereby give the Released Parties and their agents the right and permission to use my image or likeness, with or without my name, for promotional purposes. I hereby waive my right to approve any use of my image or likeness in any form. I have read and understand the rules and stipulations herein displayed, and by signing this document from this point forward I am signaling that I accept and understand that I have been advised to contact legal counsel if I do not understand the nature and legal effects of this full and final release.

MEMBERSHIP BILLING

Membership fees are billed on a monthly basis by our management software. All members must have a valid form of payment on file

for the membership to be billed each month. Failure to provide a valid form of payment and/or failure to pay membership fees will

result in a suspension or termination of your membership.

REFUNDS AND/OR CREDIT

Membership is billed on a monthly basis regardless of your attendance. Absolutely no refunds or credit will be given for any amount of

time that you are not in attendance.

PAUSING YOUR MEMBERSHIP

You may pause your membership for up to two months without losing your current membership rate. After two months you may

resume your membership at the current rates for the academy which may be higher that when you originally joined. This excludes military personnel.

CANCELING YOUR MEMBERSHIP

Whether you have a contract or not, you must cancel your membership in writing by sending an email to

[email protected]. Once your membership has lapsed for more than two billing cycles (months) you will no longer be able resume classes at your current membership rate.
